Medical Marijuana Facilities- Zoning Ordinance

In response to Pennsylvania’s Medical Marijuana Program (Act 16 of 2016), Haverford Township has proposed Ordinance P-6-2017, to establish appropriate zoning regulations for Medical Marijuana facilities.  The Medical Marijuana Act provides few opportunities for local land use and zoning controls.  Rather, the state maintains full control of the program.  Section 2107 of the Act, which covers zoning, mandates that medical marijuana uses be allowed in appropriate industrial or commercial zoning districts. Even without specific zoning, medical marijuana dispensaries may not be located within 1,000 feet of a school or day-care center as specified in Section 802.3 of the Act.  The PA Medical Marijuana Act provides that Medical Marijuana Growers/Processors and Dispensaries meet the same municipal zoning and land use requirements as other facilities that are located in the same zoning district.

The medical marijuana program became effective on May 17, 2016, and is expected to be fully implemented by 2018. The program will offer medical marijuana to patients who are residents of Pennsylvania and under a physician’s care for the treatment of a serious medical condition as defined by Act 16.

Haverford Township's proposed Ordinance P-6-2017, Medical Marijuana Zoning and Land Use Regulations will have a first reading at the Board of Commissioners meeting of May 8, 2017.  A copy of the ordinance can be found here.
